Abstract

Student involvement in motorcycle gangs raises questions of law enforcement and the protection of children's rights. This article examines the implementation of Law Number 35 of 2014 amending Law Number 23 of 2002 on Child Protection, the handling of a student case, and possible rehabilitation measures at SMK Swasta Mustafa Perbaungan. The article draws on a thesis and applies qualitative analysis to a single case involving a 17-year-old student. The materials consist of accounts of interviews, observations, police and school documents, and legal materials reported in the thesis. The findings associate the student's involvement with peer relationships, limited parental supervision, social media exposure, and the need for recognition. The case was reportedly handled through diversion involving the police, school, parents, and the correctional guidance agency, followed by counseling and religious guidance. However, protection remained incomplete because psychological assistance was not sustained, interagency coordination lacked a structured arrangement, and the students experienced stigma after returning to school. The findings distinguish case resolution from the restoration of the child's educational and social life. The article recommends an integrated approach encompassing school handling procedures, stronger guidance and counseling services, family participation, and cooperation with social services and law enforcement agencies. Its conclusions are limited to the reported case. The available documents do not establish whether all legal requirements for diversion were fulfilled or whether the interventions produced sustained outcomes.
