Abstract

Corruption in disaster funds poses a distinctive challenge to law and development because it diverts public resources intended to protect communities whose social and economic conditions have already been weakened by disasters. This article examines the relationship between legal development, anti-corruption policy, disaster governance, and human rights protection in Indonesia. Using normative juridical research with statutory, conceptual, and comparative-policy approaches, the study analyzes the 1945 Constitution, Law Number 24 of 2007 on Disaster Management, the anti-corruption legal framework, disaster financing regulations, and relevant legal scholarship. The study finds that a state-loss-centered approach is insufficient to capture the broader developmental consequences of corruption in disaster governance. Misappropriation, abuse of authority, procurement manipulation, and diversion of emergency resources may weaken institutional capacity, delay recovery, deepen vulnerability, and impair the enjoyment of social and economic rights. The article proposes a human-rights-based legal development model comprising five pillars: victim-centered accountability, transparent emergency financing, risk-based prevention, integrated institutional supervision, and recovery-oriented remedies. This model complements criminal liability by linking anti-corruption enforcement with constitutional commitments to welfare, social justice, accountable governance, and resilient development.
